Introducing Pulse, the social network designed for creating meaningful connections with your family and friends that is your innermost circle. Pulse is not just another crowded social media platform, but a platform exclusively for your tribe. Whether it’s your family or your best friends, Pulse is a place to connect with the people who matter most to you.
With Pulse, you can share your mood and experiences along with written and visual content with your inner circle, check in with your tribe to see how they're doing and keep up with their latest moods and track your own wellbeing with the private diary feature ( “Services”).
These Terms of Use (“Terms”) are a contract between you (or “User”) and Pulse Dialect Ltd, registered at 71-75 Shelton Street Covent Garden, London WC2H 9JQ United Kingdom, and its affiliates incorporated and operating under the laws of the United Kingdom or any another jurisdiction (referred as “Pulse”, “us”, “we” or “our”).
By accessing Pulse, you confirm that you are in agreement with and bound by terms contained in the Terms outlined below. These terms govern your access and use of the Services and apply to the entire platform, website, application, APIs, and any email or other type of communication between you and Pulse. If you do not agree to these Terms of Use, please do not use Pulse.
These Terms (which include and incorporate other policies including the Privacy Policy and Community Guidelines) constitute the entire agreement (“Agreement”) and understanding between you and Pulse regarding your use of the app and supersedes all prior and contemporaneous written or oral agreements between you and Pulse.

Pulse partners with external entities, including service providers, regulators, legal authorities, government bodies, and affiliate organizations to deliver its Services (“Third Parties”). These parties could be involved in processing or jointly controlling personal data and collaborate with us to enhance user experience, provide services, comply with legal requirements, and share information based on user consent or applicable laws. These parties may access, process, and collect user information through APIs, advertisements, third-party content, and integrations as described in their respective privacy policies.
If any provision of the Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Users and License
In order to use Pulse, you will need to create a user account (“User Account”) with us. We will ask you to provide the following information that corresponds to your own identity in a correct and accurate manner:
· your first name and surname;
· your e-mail address;
· your phone number;
· your date of birth.
Information relating to your User Account must be kept confidential. If you think that your User Account is compromised or being used by a third person without your consent, please notify us through an email to team@ourpulse.io.
Pulse is open to everyone subject to the following restrictions:
a) You must be at least 16 years old.
b) You are not a person prohibited from receiving any aspect of our services under the laws of the applicable jurisdiction.
c) Your account was not disabled previously by Pulse for violation of law or our Terms complemented by the Community Guidelines.
d) If you’re accepting these Terms on behalf of an organisation including a company, government, institution or any other legal entity, you have the required authority to represent and bind the organisation to these Terms.
We reserve the right to modify the user’s name, surname, or similar identifiers chosen for their account, should we determine that it is necessary or appropriate. This may occur in cases such as intellectual property infringement or impersonation of another user representing whether a real person or legal entity.
Pulse grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install and use its services strictly in accordance with the Terms.
Content
You’re responsible for what you create, share, post, collaborate and distribute on Pulse. This includes but not limited to any text, audio or visual media including images, photos, videos (collectively defined as “Content”).
Content includes data, information and references from other external sites or third-party websites, applications, products, and services ("Third Parties").
We may also display, include, or make available content from Third Parties, which are provided solely as a convenience to you. Your access and use are entirely at your own risk and subject to such Third Parties' terms of use. Pulse does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third Parties.
When sharing any content on Pulse, you must follow and safeguard our Community Guidelines as well as the applicable laws and regulations. You can limit the visibility of the content you share and keep it private. You must share content with others at your own risk, and only if and when you feel comfortable to do so.
We do not approve, endorse, or ensure the accuracy, truthfulness, completeness, or reliability of any content shared on Pulse. When you use our Services, you may come across content that is offensive, harmful, inaccurate, inappropriate, or misleading. We ask our Users to report such content to us and we will take necessary actions. The responsibility for any content lies solely with the person who originated it on Pulse. We do not monitor or control the Content generated by its Users on and we can not be held responsible for it.
Pulse reserves its right to remove provisionally or absolutely any content that is illegal or incompatible with the Terms. This includes our right to remove, suspend or restrict your access to any Content including but not limited to circumstances where we reasonably believe it is unlawful or in breach of these Terms, Privacy Policy or our Community Guidelines including any intellectual property infringements such as copyright or trademark violations or when (ii) it causes harm to us, Affiliates, our users or Third Parties.
User Obligations
When using Pulse, you agree to comply with the applicable laws the Terms, our policies including Privacy Policy and Community Guidelines and in particular with the following obligations:
a) You must not disclose inaccurate information.
b) You must not disrespect the personal rights of other people.
c) You must not impersonate someone or something that you are not, and you can't create an account for someone else or a legal entity unless you have the authority or their express permission.
d) You must not sell, license, or acquire any account or data that has been obtained from Pulse.
e) You must not engage in any activities that contravene with other users’ rights, including but not limited to intellectual property rights such as copyright infringement, trademark infringement, or selling counterfeit or pirated goods.
f) You must not use Pulse in illegal, fraudulent, or illegitimate way, discriminatorily, violently, to harm another person or group or to harass other people sexually or in another way.
g) You must not violate the intellectual property rights of others, or commercially abuse the Content.
h) You must not misuse any reporting including inaccurate and groundless reports.
i) You must not collect information, data, or Content about other Users in the absence of their consent.
Privacy
When you use our Services, we may collect and use your information. Our Privacy Policy outlines how we collect, use, and share information, as well as the various ways you can control your information. By using our Services, you consent to the collection and use of your information by us, as outlined in our Privacy Policy, including the transfer of this information to the Third Parties for such reasons as the provision of the Services.
Intellectual Property
Pulse and its entire Contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by Pulse, its licensors or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of Pulse, unless and except as is expressly provided in these Terms.
In the event that you submit or post any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, you expressly agree that such submissions will automatically be treated as non-confidential and non-proprietary. Pulse and its affiliates shall have no obligations with respect to such submissions or posts and may use the ideas contained in such submissions or posts for any purposes in any medium in perpetuity.
Limitation of Liability
We will act with professional diligence when delivering the Services. However, we do not take responsibility for loss or damage caused by incidents beyond our reasonable control.
Pulse is provided to you "as is" and "as available" and with all faults and defects without warranty of any kind. Pulse is not responsible for any content, code or any other imprecision. Pulse does not provide warranties or guarantees. In no event shall Pulse be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service.
To the maximum extent permitted by applicable law, in no event shall Pulse or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the app, third-party website, software and/or third-party hardware used with the app, or otherwise in connection with any provision of these Terms), even if Pulse or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Pulse is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, those persons who choose to access Pulse from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The Services may contain links to other Third Parties including applications, websites, products, and services not operated or controlled by Pulse. We are not responsible for the content, accuracy or opinions expressed by these third parties and such they are not investigated, monitored or checked for accuracy or completeness by us.
Changes to our Services and Terms
Pulse reserves the right to modify, suspend or discontinue, temporarily or permanently, its applications, websites, or any aspect of its services to which it connects, with or without notice and without liability to you. Pulse may from time to time provide enhancements or improvements to the features/functionality of its services, which may include patches, bug fixes, updates, upgrades and other modifications.
Pulse reserves the right to modify its Terms as well as other policies including but not limited to the Privacy Policy and Community Guidelines at any time to the extent that the relevant framework allows. In this case, we will publish the new versions of the Terms on our website and we will also send an email to you relating to the amendments 15 (fifteen) days prior to the taking effect of such amendments.
Termination
This Agreement shall remain in effect until terminated by you or by Pulse.
You acknowledge and agree that Pulse may stop (permanently or temporarily) providing the Service (or any features within the Service) to you or to users generally at Pulse’s sole discretion, without prior notice to you.
This Agreement may be terminated immediately, without prior notice from Pulse, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the app and all copies thereof from your device. Termination of this Agreement will not limit any of Pulse's rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.
Pulse is entitled to delete or suspend a User Account with or without notice as it deems appropriate and to the extent that such action by us is compatible with the legal requirements. Even when your account is deleted or suspended, Pulse can still use your data, or the Content shared by you to comply with its legal obligations.
